México concluye la investigación sobre Minera Peñasquito, S.A. de C.V., en el marco del MLRR del T-MEC

El Gobierno de México, a través de la Secretaría del Trabajo y Previsión Social (STPS), a cargo de Marath Bolaños López, concluyó exitosamente la investigación sobre la presunta denegación de derechos de libertad de asociación y negociación colectiva en Minera Peñasquito, S.A. de C.V. (Peñasquito), ubicada en Mazapil, Zacatecas. Lo anterior, en el marco del Mecanismo Laboral de Respuesta Rápida en Instalaciones Específicas (MLRR) del Anexo 31-A del Tratado entre México, Estados Unidos y Canadá (T-MEC).

En los resultados de la investigación realizada por la STPS, que el Gobierno de México compartió con el Gobierno de Estados Unidos el 28 de julio de 2026, respecto a la presunta discriminación antisindical consistente en despidos injustificados de tres personas trabajadoras, derivados de su actividad y/o preferencia sindical, se identificó lo siguiente:

  1. Primer trabajador: la STPS identificó que, al momento de ser despedido, relacionado con la avería de un equipo de trabajo, esta persona se encontraba participando en un proceso como candidato para ocupar el cargo de secretario general local. Asimismo, se identificó que, luego del despido, la persona trabajadora fue nombrado por el sindicato titular y ejerció efectivamente como delegado especial y comisionado en la revisión del contrato colectivo de trabajo (CCT).
  2. Segundo trabajador: la STPS identificó que, al momento de su despido, relacionado con la sustracción de un material de trabajo, no desempeñaba cargo alguno dentro del comité sindical ni formaba parte de alguna comisión sindical.
  3. Tercer trabajador: la STPS identificó que, al momento de su despido, relacionado con una acusación por presunto acoso sexual, formaba parte de la Comisión Revisora del CCT 2024. Asimismo, la STPS identificó que, luego de la separación laboral, el extrabajador continuó participando como integrante de la comisión revisora en el cargo que le fue designado por el sindicato titular.

Durante el periodo de 45 días de investigación y en coordinación y bajo el monitoreo directo de la STPS, Peñasquito implementó las siguientes acciones orientadas a reforzar el respeto, protección y garantía de los derechos colectivos de las personas trabajadoras en este centro de trabajo:

  • La suscripción, publicación y difusión de una Carta de Neutralidad en asuntos sindicales y un documento que define los Lineamientos de Conducta por parte del personal de la empresa.
  • La publicación de un mecanismo formal, claro y confidencial de denuncia, desarrollado en coordinación con la STPS, que incluye formatos físicos en áreas de mayor tránsito de la planta para reportar posibles violaciones laborales sin temor a represalias.
  • La suscripción de una carta compromiso, en la que Peñasquito se obliga a entregar copias de la Carta de Neutralidad y de los Lineamientos de Conducta a la totalidad de las personas trabajadoras, capacitarlas sobre su contenido y brindar todas las facilidades necesarias para que la STPS imparta capacitaciones en materia de libertad sindical, democracia sindical y negociación colectiva.

Además de lo anterior, la STPS coordinará mesas de diálogo entre la empresa y el sindicato titular, con el objetivo de llegar a un acuerdo sobre el primer y segundo trabajador.

En consecuencia y derivado de las conversaciones entre los gobiernos de México y Estados Unidos al respecto de este caso, las medidas aquí enunciadas formarán parte de un Plan de Reparación acordado conjuntamente.

El Gobierno de México refrenda su compromiso con la aplicación efectiva de los derechos colectivos de las personas trabajadoras, conforme a la legislación nacional y a los compromisos internacionales asumidos.

Mexico concludes its investigation into Minera Peñasquito, S.A. de C.V., under the USMCA’s MLRR

The Mexican government, through the Ministry of Labor and Social Welfare (STPS), headed by Marath Bolaños López, successfully concluded its investigation into the alleged denial of the rights to freedom of association and collective bargaining at Minera Peñasquito, S.A. de C.V. (Peñasquito), located in Mazapil, Zacatecas. This investigation was conducted within the framework of the Rapid Response Labor Mechanism for Specific Facilities (RRML) of Annex 31-A of the United States-Mexico-Canada Agreement (USMCA).

The results of the investigation conducted by the STPS (Mexican Ministry of Labor and Social Welfare), which the Mexican government shared with the United States government on July 28, 2026, regarding alleged anti-union discrimination consisting of the wrongful termination of three workers due to their union activity and/or affiliation, identified the following:

First worker: The STPS determined that, at the time of his termination, related to a breakdown of work equipment, this individual was participating in a process as a candidate for the position of local general secretary. It was also determined that, after his termination, the worker was appointed by the union and effectively served as a special delegate and commissioner in the review of the collective bargaining agreement (CBA).

Second worker: The STPS determined that, at the time of his termination, related to the theft of work materials, he did not hold any position within the union committee nor was he a member of any union commission.

Third worker: The STPS (Ministry of Labor and Social Welfare) identified that, at the time of his dismissal, related to an accusation of alleged sexual harassment, he was a member of the 2024 Collective Bargaining Agreement Review Committee. The STPS also identified that, after his termination, the former employee continued to participate as a member of the review committee in the position to which he had been appointed by the union.

During the 45-day investigation period, and in coordination with and under the direct monitoring of the STPS, Peñasquito implemented the following actions aimed at reinforcing respect for, protection of, and guarantee of the collective rights of workers at this workplace:

The signing, publication, and dissemination of a Letter of Neutrality in union matters and a document that defines the Code of Conduct for company personnel.

The publication of a formal, clear, and confidential reporting mechanism, developed in coordination with the STPS, which includes physical forms in high-traffic areas of the plant to report possible labor violations without fear of retaliation. The signing of a letter of commitment, in which Peñasquito agrees to provide copies of the Neutrality Charter and the Code of Conduct to all employees, train them on its content, and provide all necessary support for the Ministry of Labor and Social Welfare (STPS) to conduct training sessions on freedom of association, union democracy, and collective bargaining.

In addition, the STPS will coordinate dialogue sessions between the company and the union, with the aim of reaching an agreement regarding the first and second workers.

Consequently, and as a result of the discussions between the governments of Mexico and the United States regarding this case, the measures outlined here will form part of a jointly agreed-upon Reparation Plan.

The Government of Mexico reaffirms its commitment to the effective application of workers’ collective rights, in accordance with national legislation and the international commitments undertaken.
