Nuevo Criterio Obligatorio en México sobre la Recaída Derivada de un Riesgo de Trabajo

Hechos: Los Tribunales Colegiados de Circuito contendientes sustentaron criterios discrepantes al analizar cuál es el salario que debe servir como base para calcular las prestaciones originadas por una recaída derivada de un riesgo de trabajo, esto es, si debe atenderse al vigente al ocurrir el riesgo de trabajo o cuando se actualiza la recaída.

Al conocer de la contradicción de criterios, este Pleno Regional fijó como punto a dilucidar el siguiente: Cuando se presenta una recaída derivada de un riesgo de trabajo, ¿debe aplicarse lo dispuesto en el artículo 74, fracción I, del Reglamento de la Ley del Seguro Social en Materia de Afiliación, Clasificación de Empresas, Recaudación y Fiscalización y tomar en cuenta el salario vigente al momento de la recaída; o bien, los artículos 58, fracción I, y 62 de la Ley del Seguro Social deben interpretarse de manera sistemática, de modo que el salario a considerar sea el vigente al momento en que ocurrió originalmente el riesgo de trabajo?

Criterio Jurídico: El salario que debe tomarse como base para cuantificar y pagar las prestaciones en dinero derivadas de una recaída originada por un riesgo de trabajo previamente reconocido por el Instituto Mexicano del Seguro Social, es el que la persona asegurada tenga registrado al momento en que dicho instituto determine procedente la recaída, conforme al artículo 74, fracción I, del Reglamento de la Ley del Seguro Social en Materia de Afiliación, Clasificación de Empresas, Recaudación y Fiscalización.

Justificación: De los artículos 58, fracción I, y 62 de la Ley del Seguro Social se advierte que regulan las prestaciones en dinero a las que tienen derecho las personas aseguradas que sufren un riesgo de trabajo, contemplándose en ellos hechos generadores distintos.

El primero establece que el salario base de cotización que debe tomarse en cuenta para calcular las prestaciones derivadas de un riesgo de trabajo es el vigente al momento en que éste ocurre, por constituir el hecho que les da origen.

Por su parte, el indicado artículo 62 regula un momento posterior derivado de una recaída, en cuyo caso tendrá derecho a recibir el subsidio a que se refiere el aludido artículo 58, fracción I, sin embargo, dicho precepto no precisa cuál es el salario que debe tomarse en cuenta para pagar la prestación.

Para resolver tal disyuntiva, debe recurrirse al artículo 74, fracción I, del Reglamento de la Ley del Seguro Social en Materia de Afiliación, Clasificación de Empresas, Recaudación y Fiscalización, en el que se prevén las hipótesis que pueden actualizarse con motivo de una recaída derivada de un riesgo de trabajo o enfermedad profesional, tales como el otorgamiento de nuevos subsidios o, en su caso, el reconocimiento de una pensión.

Además, dicho precepto establece que para efectos del pago del subsidio a que se refiere el primer párrafo del señalado artículo 62 deberá tomarse como base el salario que la parte trabajadora tenga registrado al momento en que el instituto determine la procedencia de la recaída.

Por tanto, constituye un complemento de lo dispuesto por dicho numeral, ya que desarrolla las hipótesis que del mismo derivan, con la finalidad de facilitar su aplicación práctica y asegurar su exacta observancia.

Así, las disposiciones del Reglamento deben entenderse como un complemento de la Ley del Seguro Social, al haberse emitido en ejercicio de la facultad reglamentaria del Poder Ejecutivo y con fundamento en la habilitación otorgada por el propio legislador para que determinadas cuestiones contempladas en la indicada norma fueran desarrolladas y reguladas a través de sus disposiciones reglamentarias.

Cabe destacar que el citado artículo 74, fracción I, no excede los límites de la facultad reglamentaria ni modifica el contenido de la ley señalada, sino que únicamente desarrolla y complementa lo dispuesto por el mencionado artículo 62 para lograr su adecuada aplicación.

New Mandatory Criteria in Mexico Regarding Relapse Resulting from a Work Risk

Facts: The opposing Circuit Courts of Appeals held differing opinions when analyzing which salary should serve as the basis for calculating benefits arising from a relapse due to a work-related injury or illness; that is, whether the salary in effect at the time of the work-related injury or illness should be used, or the salary in effect at the time of the relapse.

Upon learning of the conflicting opinions, this Regional Plenary Session established the following point for clarification: When a relapse occurs due to a work-related injury or illness, should the provisions of Article 74, Section I, of the Regulations of the Social Security Law on Affiliation, Classification of Companies, Collection, and Auditing be applied, taking into account the salary in effect at the time of the relapse; or should Articles 58, Section I, and 62 of the Social Security Law be interpreted systematically, so that the salary to be considered is the one in effect at the time the work-related injury or illness originally occurred?

Legal Criterion: The salary to be used as the basis for calculating and paying monetary benefits arising from a relapse caused by a work-related injury previously recognized by the Mexican Social Security Institute (IMSS) is the salary the insured person has registered at the time the IMSS determines the relapse is valid, in accordance with Article 74, Section I, of the Regulations of the Social Security Law on Affiliation, Classification of Companies, Collection, and Auditing.

Justification: Articles 58, Section I, and 62 of the Social Security Law regulate the monetary benefits to which insured persons who suffer a work-related injury are entitled, and they address different triggering events.

The former establishes that the base salary for contributions to be considered when calculating benefits arising from a work-related injury is the salary in effect at the time the injury occurs, as this constitutes the event that gives rise to the benefit.

For its part, Article 62 addresses a subsequent situation arising from a relapse, in which case the employee will be entitled to receive the subsidy referred to in Article 58, Section I. However, this provision does not specify which salary should be considered for calculating the benefit.

To resolve this ambiguity, one must refer to Article 74, Section I, of the Regulations of the Social Security Law on Affiliation, Classification of Companies, Collection, and Auditing, which outlines the scenarios that may arise from a relapse due to a work-related risk or occupational disease, such as the granting of new subsidies or, where applicable, the recognition of a pension.

Furthermore, this provision establishes that, for the purposes of calculating the subsidy referred to in the first paragraph of Article 62, the salary registered to the employee at the time the Institute determines the relapse must be used as the basis.

Therefore, it complements the provisions of said article, as it elaborates on the hypotheses derived therefrom, with the aim of facilitating its practical application and ensuring its strict observance.

Thus, the provisions of the Regulations should be understood as a complement to the Social Security Law, having been issued in the exercise of the regulatory power of the Executive Branch and based on the authorization granted by the legislature itself for certain matters contemplated in the aforementioned law to be developed and regulated through its regulatory provisions.

It is worth noting that the aforementioned Article 74, Section I, does not exceed the limits of the regulatory power nor does it modify the content of the aforementioned law; rather, it merely develops and complements the provisions of the aforementioned Article 62 to ensure its proper application.
