Labor compensation agreement reached at the Peñasquito gold mine

Following the intervention of the USMCA’s Rapid Response Labor Mechanism, the National Mining Union, headed by Napoleón Gómez Urrutia, and the US-based Newmont formalized reparations measures for labor rights violations at the Peñasquito gold mine in Zacatecas, including the reinstatement of a worker who was unjustly dismissed.

The agreement was signed by national leader Gómez Urrutia and the company, after the Ministry of Labor and Social Welfare (STPS) determined last August that the company had violated the rights to freedom of association and collective bargaining of the miners in Section 304.

“With this agreement, the National Mining Union reiterates its ongoing commitment to constructive dialogue and good-faith negotiation with companies, provided that this entails unrestricted respect for freedom of association, collective bargaining, and the dignity of workers,” the union stated.

As part of the process, the STPS (Mexican Ministry of Labor and Social Welfare) coordinated dialogue sessions between Newmont and the miners’ union to seek agreements regarding two cases of dismissed workers. One case has already been resolved with the reinstatement of the workers, while the second remains pending. Therefore, redress for the harm caused will continue within the framework of the Reparations Plan agreed upon by the governments of Mexico and the United States.

Among the agreed-upon measures, Newmont was required to publish a letter of neutrality to strengthen guarantees for the exercise of freedom of association, create a confidential mechanism for reporting potential labor violations, and train its personnel in collectiv
