General Law for Substantive Equality between Women and Men: What’s Next?

On January 15, 2026, the Decree reforming, among other provisions, the former General Law for Equality between Women and Men was published in the Official Gazette of the Federation. Its name was changed to the General Law for Substantive Equality between Women and Men.

The reform seeks to strengthen the institutional framework to guarantee substantive equality between women and men, understood not simply as equality before the law, but as the elimination of obstacles and discriminatory practices that prevent such equality from being effectively realized in the various spheres of daily life.

These legislative changes, of course, had implications for labor matters.

The Law for Substantive Equality establishes that the National Policy must include actions to achieve substantive equality and includes measures related to eliminating the gender pay gap. It also includes the promotion of working conditions that prevent harassment and sexual harassment.

The above must be analyzed in conjunction with the reforms made to labor legislation in this area. In particular, the Federal Labor Law already recognizes substantive equality as a principle that must govern labor relations, and it considers harassment and sexual harassment as conduct that warrants termination of the employment relationship without liability for the employee.

In this sense, the challenge will be not only to ensure the recognition of substantive equality in the law, but also to develop its effective implementation in workplaces, particularly through equality policies, measures to prevent and address workplace discrimination, and actions aimed at reducing the wage gap.

Now, the next step is its effective implementation through the instruments provided for by the Law itself. These include the National Policy on Substantive Equality between Women and Men and the National Program of Strategic Projects for Substantive Equality between Women and Men. The latter, corresponding to the period 2026-2030, was already published on May 18, 2026 and establishes objectives, strategies and lines of action to implement the National Policy.
