The Official Gazette of the Federation (DOF) publishes an agreement that modifies the pilot program of the Agro-export Labor Certificate.
The Ministry of Labor and Social Welfare (STPS) has modified the rules of the pilot program for the Labor Certificate for Agricultural Exports (CLA), a mechanism created to certify compliance with labor and social security obligations in the production chains of agricultural products destined for international markets.
Through an agreement published in the Official Gazette of the Federation (DOF), the ministry amended the Ninth Provision of the general provisions that regulate the procedures for obtaining this certificate, published on June 15.
The main change is that the pilot program will now last at least 12 months for each agricultural product specified in the corresponding agreement. Previously, the period was established as a maximum or fixed term.
According to the STPS, this modification will allow the program to continue for as long as necessary for its implementation, evaluation, and, if needed, adjustments, taking into account the specific characteristics of each agricultural product.
The certificate will be mandatory during the pilot program.
The agreement also establishes that, during the pilot phase, the Labor Certificate for Agro-exports will be mandatory, in accordance with the provisions issued by the competent authorities.
The Labor Certificate for Agro-exports (CLA) stems from the reform published on May 1, 2016, which incorporated Article 283 Quater into the Federal Labor Law. This reform granted the Ministry of Labor and Social Welfare (STPS) the authority to issue a certificate that verifies compliance with labor and social security obligations related to the production, packaging, marketing, and export of agricultural products.
The measure aims to strengthen labor due diligence throughout the value chains and facilitate the ability of agro-export companies and other participants in these processes to demonstrate that their products comply with current formalization and social protection standards in Mexico, as well as with commitments arising from international treaties.
Toward Regulation for Agricultural Exports
The Ministry of Labor and Social Welfare (STPS) indicated that the CLA (Certificate of Agricultural Export) will become mandatory as a non-tariff regulatory and restrictive measure for the export of agricultural products as determined by the authorities.
Therefore, the new agreement seeks to harmonize labor provisions related to the certificate with the applicable foreign trade regime.
The agreement enters into force on September 15, 2026, the same day as its publication in the Official Gazette of the Federation (DOF).
